This portal is made available pursuant to orders of the Supreme Court of Victoria.

This portal allows Group Members in the Mayne Pharma Class Action who have not previously registered with Phi Finney McDonald to give their contact details so that they can receive important notices from the Supreme Court of Victoria about the proposed settlement of the Mayne Pharma Class Action.

IMPORTANT: PROVIDING YOUR CONTACT DETAILS USING THIS PORTAL DOES NOT MEAN YOU ARE REGISTERED TO PARTICIPATE IN THE PROPOSED SETTLEMENT OF THE MAYNE PHARMA CLASS ACTION.

You are a Group Member in the Mayne Pharma Class Action if:

(a) you acquired an interest in fully paid ordinary shares in Mayne Pharma during the period between 24 November 2014 and 15 December 2016 (inclusive);

(b) you have suffered loss or damage by reason of the conduct of Mayne Pharma pleaded in the Amended Statement of Claim; and

(c) you are not:

(i) a related party, a related body corporate, an associated entity, or an officer or associate of Mayne Pharma; or

(ii) a Justice or the Chief Justice of the Supreme Court of Victoria, or a Justice or the Chief Justice of the High Court of Australia.

The Supreme Court of Victoria previously made orders that only those Group Members who registered their claim with Phi Finney McDonald by 4:00pm AEST on 28 June 2023 are eligible to participate in the proposed settlement of the Mayne Pharma Class Action.

• If you did not register with Phi Finney McDonald by 4:00pm AEST on 28 June 2023, you are not eligible to participate in the proposed settlement of the Mayne Pharma Class Action without permission from the Court.

 

• If you provided an opt out notice prior to 4:00pm AEST on 28 June 2023 to opt out of the proceeding, you are no longer a Group Member and are not bound by the proposed settlement in this proceeding.

 

• If you did not opt out of the proceeding, you will be bound by the proposed settlement even if you are not, and do not now seek permission to become, a Registered Group Member.

 

• If you registered your claim with Phi Finney McDonald by 4:00pm AEST on 28 June 2023, you are a Registered Group Member and you do not have to use this portal to receive a benefit from the settlement.
